Terms of Use

1. Agreement

These Terms of Use (“Terms”) govern your access to and use of the Da Dink Files mobile application and related websites and services (collectively, the “Service”). The Service is developed and published by Skip Studios LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

2. Eligibility

You must be able to form a binding contract in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Your account

You are responsible for the accuracy of information you provide and for keeping your sign-in credentials secure. You are responsible for activity that occurs under your account. Notify us promptly via our Support page if you suspect unauthorized access.

4. The Service

Da Dink Files is a pickleball game journal and performance intelligence tool. You may log sessions and scores, keep private observations, and view statistics and insights derived from your play history. We may update, suspend, or discontinue features at any time.

The Service does not display third-party advertisements. By using the app, you acknowledge that we may collect and process certain information as described in our Privacy Policy, including contact information, identifiers, usage data, and diagnostic information, for app functionality and analytics — not for tracking or third-party advertising.

5. Acceptable use

You agree not to:

• Use the Service for unlawful, harassing, or fraudulent purposes
• Attempt to access another user’s account or private data
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, scrape, or misuse the Service except as allowed by law
• Misrepresent scores, identities, or other material information

6. Your content

You retain ownership of content you submit (such as scores, notes, and profile information). You grant us a limited license to host, process, and display that content solely to operate and improve the Service. You are responsible for ensuring you have the right to submit content involving other players where applicable.

7. Intellectual property

The Service, including branding, software, and design, is owned by Skip Studios LLC or its licensors. These Terms do not grant you any ownership interest in the Service beyond a limited, revocable right to use it as intended.

8. Analytics and diagnostics

We may use analytics and diagnostic tools (such as crash reporting) to understand how the Service is used, improve performance, and fix bugs. These tools may collect identifiers, usage data, and crash data as described in our Privacy Policy. They are not used for third-party advertising or cross-app tracking.

9. Disclaimers

The Service is provided “as is” and “as available.” Scores, statistics, and insights are informational tools for personal use — they are not professional coaching, medical, or competitive certification advice. We do not warrant uninterrupted or error-free operation.

10. Limitation of liability

To the fullest extent permitted by law, Skip Studios LLC and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of (a) amounts you paid us for the Service in the twelve months before the claim or (b) fifty U.S. dollars (USD $50).

11. Account deletion

You may request deletion of your account and associated data by submitting an Account Deletion Request in the app (Profile) or through our Support page. We may verify your identity before completing deletion. See our Privacy Policy for details.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes the types of data we collect (including contact information, identifiers, usage data, and diagnostics), how data may be linked to you, and your choices regarding deletion.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. Material changes will be reflected by updating the “Last updated” date above.

14. Governing law

These Terms are governed by the laws of the United States and the State of Hawaii, without regard to conflict-of-law principles, except where mandatory local consumer law applies.
